Lawyer is a general term for legal practitioners which includes attorneys and advocates.
Attorneys and advocates have the same degree qualifications but they receive different training. Attorneys typically conduct practice in firms and conduct general practices whilst advocates work independently. Advocates are court specialists and often focus on specific areas of the law.

The cost of hiring an attorney can vary depending on a number of factors such as the complexity of the case, the urgency of the matter, the type of matter, the experience and reputation of the lawyer and the value of the matter to the client.

Generally, attorneys charge an hourly rate, a fixed fee, or a combination of both. In addition to charging for their time, the attorney will incur costs on behalf of the client and these disbursements will be charged to the client’s account. Rates can range from R800 to R4,000 or more per hour.

In estate matters, the executor is entitled to charge 3.5% of the value of the estate, subject to the discretion of the Master of the High Court.

In conveyancing matters, attorneys base their fees on a tariff which is linked to the value of the property being transferred.

It’s important to note that lawyers may require an upfront deposit, which is paid as cover for expected fees and disbursements to secure the services of the lawyer.

An initial consultation can be conducted over the phone or briefly in person. The idea is for the lawyer to briefly assess the situation and to provide you with general advice regarding the process and costs involved in pursuing your matter.

The attorney may only charge you once you have mandated him/her formally.
